Tri Valley Constrictors strives to provide customers with 100% satisfaction. To this end, we will make all efforts to ensure that each and every boa we provide to our customers will be both truthfully and accurately represented (through digital photography and/or written description) and we will offer and ship only 100% healthy constrictors (disease-, mite-, and tick-free).

Purchase Terms

Delivery Guarantee
Tri Valley Constrictors (hereinafter also referred to as TVC) offers a delivery guarantee that provides a 48-hour protection period from time of delivery* that is intended to assure customers of our commitment to honesty, accuracy, and quality. We guarantee live delivery of the exact same boa you purchased. Under this guarantee, a customer who finds that our snake’s description or health was misrepresented may contact Tri Valley Constrictors within 48-hours of delivery to request an exchange for a full refund or for replacement with a boa of equal value.

*Restrictions and Requirements for the Delivery Guarantee: Any and all shipments must be signed for on the first delivery attempt. Failure to sign for and accept delivery on the first delivery attempt voids the Delivery Guarantee. Tri Valley Constrictors is not responsible for and will not offer refunds or exchanges for any boa that is dead on arrival (DOA) after a failed first delivery attempt. For this reason, it is imperative that customers make arrangements to ensure acceptance according to the delivery arrangements agreed to by both the customer and TVC at time of purchase.

Reservations
Customers may request a reservation for a particular boa morph any time after breeding has taken place. Schedules and updates for particular breeding projects will be provided, as timely as possible, on the TVC web site (www.trivalleyconstrictors.com).
Customers with reservations are required to send a 20% non-refundable deposit within five (5) days of the birth of the reserved boa. Once the boas are born and your reservation and intention to purchase is reconfirmed, you will be able to choose your boa, which will then be taken “off the market,” separated from the litter, fed as required, and maintained to ensure perfect health. Full purchase amount must be received by Tri Valley Constrictors within fourteen (14) days of birth or the 20% deposit will be forfeited and the reserved boa will become available to the public. The only exceptions to this rule are through prearranged lay-away plans on purchases of $200 or more.

Lay-Away Plans
Lay-away plans are available both to customers reserving as-yet-unborn boas and to those choosing to buy existing boas. Lay-away plans still require the non-refundable deposit** of 20% within five (5) days of selecting your boa so that it can be taken “off the market.” Lay-away plans are available only for purchases of two-hundred dollars ($200) or more and may require an additional maintenance fee to cover feeding and maintenance of your boa until final payment is made, verified, and shipment of your boa takes place. (Any additional maintenance fees will be nominal and determined at time of reservation with approval from both the customer and TVC and these fees may be partially or completely waived for early payoff of the lay-away plan.)
Full payment for lay-away plans must be received and verified by Tri Valley Constrictors:
• within thirty (30) days for purchases from $200 to $450
• within sixty (60) days for purchases between $450 and $750
• within ninety (90) days for purchases over $750
Under no circumstance will any boa be shipped before full purchase amount is received and verified by Tri Valley Constrictors.


**Non-Refundable Deposit Conditions: If full payment is not received within the specified lay-away period, the 20% deposit will be forfeited and the reserved boa will become available to the public. Payments received by Tri Valley Constrictors that exceed the 20% deposit will be refunded within fifteen (15) days after cancellation/ default of a lay-away plan.


Payment Options


All payments, including deposits, must be made to Tri Valley Constrictors. Payment can be made by mailing cashier’s checks or money orders directly to Tri Valley Constrictors. It is best to use certified mail and to NEVER send cash. However, for your protection and convenience, TVC also makes available the ability to make payments using PayPal®. PayPal is an online payment service that is 100% secure and is free of charge to those making payments.
Note: PayPal customers must use a credit card that has the same billing address as the shipping address being used for delivery of boas. If these two addresses do not match, the transaction will not be processed and payment will not reach TVC.
Any delays due to difficulties using PayPal or due to delivery by the U.S. Postal Service may cause a chosen boa to be unavailable by the time TVC receives your payment. TVC is not responsible for such delays nor are we responsible for any losses incurred on the part of the customer as a result of these delays.

Availability
Boas are available on a first-come, first-served basis and are subject to the nature of reptile breeding. Tri Valley Constrictors (TVC) is not responsible for or obligated to offer substitutions for any reserved boas that do not survive birth or that exhibit or develop health problems between birth and shipment. Tri Valley Constrictors will always do its best to find a suitable solution to satisfy our customers but in the event that a replacement or substitution can not be found or agreed upon, TVC is obligated only to return deposits or payments received from a customer and is in no other way responsible for costs or losses incurred on the part of the customer.
Tri Valley Constrictors strives to keep its web site (www.trivalleyconstrictors.com) updated at all times. However, in the unlikely event that an online or other transaction allows a customer to unknowingly make purchase arrangements for a boa that is no longer available, that customer will be given the choice of a full refund or another boa of equal value if and when one is available. Full refunds will be the first option unless a customer requests and agrees to any conditions and time frame necessary for a replacement to become available, in which case the 20% non-refundable deposit would be retained by TVC and all other pre-paid monies would be treated according to the conditions agreed upon by both TVC and the customer.
In all situations where two or more customers attempt to purchase the same boa, the customer who first completed a reservation and/or to have a deposit received by Tri Valley Constrictors will be given first choice. In some instances, in the effort to satisfy all customers, Tri Valley Constrictors may choose, but is not obligated, to offer a boa of equal or higher value to the first customer (for the original agreed upon purchase amount) in an attempt to provide all customers with a boa of their choice.

Shipping Options

Shipping cost is included in the price of all TVC boas except in those cases where a customer’s location or special needs require a shipping method other than the normal method used by Tri Valley Constrictors***. TVC will provide the box, insulation, and any heat or cold packs as needed. TVC uses overnight delivery service, through either UPSTM or FedEx®, at our discretion and according to delivery expectations and location. Shipment date should be arranged by customers in advance and in agreement with Tri Valley Constrictors so that customers or their agents are available to accept delivery before 10 am the next morning. Failure to sign for and accept delivery on the first attempt will void the Delivery Guarantee.

***Shipping Restrictions: At this time, Tri Valley Constrictors is not equipped to offer shipment to addresses outside of the United States. Additionally, shipments cannot be made to P.O. Boxes. For the protection of TVC boas, we choose to ship only on Mondays, Tuesdays, and Wednesdays with the exception of some holiday periods. This is to help ensure that the boas are not left in a shipping building or delivery truck for an unreasonable period of time during non-delivery days. We also choose not to ship any boas when areas in the path of shipment are expecting nighttime temperatures below 40 degrees Fahrenheit or when daytime temperatures are expected to rise above 90 degrees Fahrenheit. Should a customer demand shipment outside of these parameters, the customer will first be required to sign a waiver of the Delivery Guarantee releasing TVC of responsibility for condition of boas at time of delivery. TVC can ONLY guarantee live arrival when all above shipping parameters are in place. TVC customers who request other shipping options, additional materials, or have special instructions may be charged for any amount that significantly exceeds the cost (more than 10% variance) of our normal method of shipment.

Terms, conditions, and prices may change at any time without notice. All terms, conditions, and prices in place at time of purchase will supercede any changes to this document. For the purposes of this document, “purchase” is defined as a confirmed reservation for, payment of non-refundable deposit on, or full payment toward any boa that has not yet been delivered or is still covered under the Delivery Guarantee.
